What is a T Visa?
A T visa is available to victims of human trafficking who cooperate with law enforcement in the investigation or prosecution of the perpetrator. To be eligible for a T visa, you must:
- Be or have been a victim of human trafficking
- Be in the United States, American Samoa, the Commonwealth of the Northern Mariana Islands, or at a port of entry due to trafficking

- Be the victim of certain crimes, including domestic violence, sexual assault, trafficking, and other crimes
- Suffer mental or physical abuse as a result of the crime

- Demonstrate that you would suffer extreme hardship involving unusual and severe harm if removed from the United States
- Be admissible to the United States or eligible for a waiver of inadmissibility
What is the Process of Obtaining T and U Visas?
The process of obtaining a T or U visa begins with the victim filing an application with U.S. Citizenship and Immigration Services (USCIS). The victim must show that he or she has been the victim of human trafficking or is cooperating with law enforcement in the investigation or prosecution of human trafficking.
After the application is filed, USCIS will review the application and make a decision. If USCIS approves the victim’s application, the victim will be granted a T or U visa.
